These Terms of Service ("Terms") govern access to and use of the Rectifyr observability platform, including the Rectifyr website, hosted service, dashboards, APIs, and related products (collectively, the "Service"), operated by Trustonica ("Rectifyr," "we," "us," or "our"). By creating an account, accessing, or using the Service, you ("you," "your," or "Customer") agree to be bound by these Terms. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

1. The Service

Rectifyr provides a hosted, multi-tenant observability platform built on the open-source sobs project. Rectifyr also makes the underlying sobs engine available separately under its own open-source license; use of the self-hosted, open-source software is governed by that license, not by these Terms.

2. Accounts

You must provide accurate registration information and keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.

3. Plans, Fees & Billing

Rectifyr is offered on Free, Pro, and Enterprise plans as described on our Pricing page. Paid plans are billed in advance on a recurring basis unless otherwise agreed in a separate order form or Enterprise Agreement. Fees are non-refundable except where required by law. We may change our fees on renewal with advance notice. The plan-specific limits and charges described in the footnotes of the Pricing page — including event-overage fees, ingress/egress limits, and data-retention extension pricing — are incorporated into these Terms by reference and apply to your plan.

4. Acceptable Use

You agree not to use the Service to: (a) violate applicable law; (b) transmit malware or attempt to gain unauthorized access to any system; (c) interfere with or disrupt the integrity or performance of the Service; (d) ingest data you do not have the right to process; or (e) resell or sublicense the Service without our written consent.

5. Customer Data

As between you and Rectifyr, you own the data you submit to or ingest through the Service ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and support the Service. You are solely responsible for ensuring you have the necessary rights and consents to submit Customer Data, including any personal data contained within logs, traces, or metrics you send us. 6. Service Availability

We use commercially reasonable efforts to keep the Service available, but the Free and Pro plans are provided on a best-efforts basis without a formal uptime commitment. A specific uptime service level agreement, if any, is available only under a separate Enterprise Agreement and is not incorporated into these Terms.

7. Intellectual Property

Rectifyr and its licensors retain all right, title, and interest in and to the Service, including all associated intellectual property rights. These Terms do not grant you any rights to Rectifyr's trademarks, logos, or branding except as necessary to use the Service as permitted.

8. Third-Party & Open-Source Components

The Service incorporates open-source software, including the sobs engine, each subject to its own license terms. Nothing in these Terms limits the rights granted to you under any applicable open-source license.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA LOSS WILL NOT OCCUR.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL RECTIFYR OR ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. RECTIFYR'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO RECTIFYR FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100) IF YOU ARE ON THE FREE PLAN. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold Rectifyr harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your Customer Data, or your misuse of the Service.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your right to use the Service ends immediately; provisions of these Terms that by their nature should survive (including Sections 9–11) remain in effect.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or an in-product notice) before the changes take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Arizona, and you consent to personal jurisdiction in those courts.
